When was the Receiver appointed?

On February 7, 2023, Judge (Ret.) David M. Gersten was appointed as the receiver (“Receiver”) for New World Condominium Apartments Condominium Association, Inc. (“New World”). The Court’s Order Appointing Receiver is on the “documents” page of this website. 


May insurance adjusters inspect individual units?

Not yet. Also, certain units will be accessible before others.  Insurance adjusters should email us at newworldreceivership@gmail.com to let us know they would like access and we’ll get back to them once appointments can be made to view and inspect individual units.

Do I still have to pay Maintenance and Special Assessments?

Yes. Your Maintenance and Special Assessment fees should be paid by sending a check made out to New World Condominium Apartments Condominium Association, Inc. and mailed to Damian & Valori, LLP, 1000 Brickell Avenue, Suite 1020, Miami, Florida 33131.

 

May I get into my unit to retrieve personal belongings?

Not yet. The property has been designated an “unsafe structure” by the Building Official of the City of Miami Gardens (the “City”). As such, no one is allowed to access the property unless specifically allowed by the Building Official.

We have proposed a plan to the City based on a review of the property by a structural engineer that will allow for unit owners and residents to safely get into their units to retrieve their belongings as soon as possible.

In sum, the proposal is to put up a safety barrier to block off the more damaged areas of the property from the lesser damaged areas of the property. Then, we would obtain approval of the fencing from the Building Official. Then, subject to the Building Official’s approval, we would allow residents of units 101-106, 201-207, 137-143, 239-245 to be able to get into their units to retrieve their personal belongings from their units. A few of the above units will require a “day of” determination for safety by the Building Official.

Once the fence is installed, we would also remove dangerous debris from the areas where more damage has occurred.  Once such debris is removed from the property, the other unit owners and/or residents will become eligible for supervised access to retrieve their personal belongings. Some units may be so badly damaged that special preparations may be needed for safety.

 

May I remove my car or truck which is parked on the property?

If your car or truck is parked on the property, please schedule an appointment to pick up your car or truck by emailing us at newworldreceivership@gmail.com. Please tell us the make and model so that we may make requests as needed to the Building Official.

 

When can we move back into our units?

It is unclear. We are in the process of reviewing the legal documents to determine our options.

As of now, the most likely units to be habitable first will be units 101-106, 201-207, 137-143, 239-245. In order to make them habitable again, plans (signed and sealed by the necessary architect and/or engineers) and permits will be required as well as certain work. Also, inspections, and the issuance of a temporary certificate of occupancy will be required. Without at least a temporary certificate of occupancy, utilities cannot be restored to any part of the property.

As to the other units, we do not have enough information to determine when and whether they will be habitable again. We continue to work daily on these issues and will update you as soon as we are able.
